Terms of Service

These Terms of Service ("Terms") are an agreement between you and Subdivisions Realty LLC, doing business as CMAView ("CMAView," "we," "us"), based in New Hampshire, USA. They apply when you order, subscribe to or use CMAView at cmaview.com. CMAView is a business-to-business service for real estate professionals. By placing an order or subscribing, you agree to these Terms, our Privacy Policy and our Refund and Revision Policy.

1. The service

You send us a comparative market analysis ("CMA") you prepared, for example a PDF from your MLS or CMA software. We turn it into an interactive web dashboard with your branding and compliance footer and host it at an unlisted, passcode-protected link that you share with your client. Packages, turnaround times and features are described on our pricing page at the time you order.

2. Your responsibilities

• Rights to the content. You must have the right to share everything you send us, including MLS data, listing photos, and your client's name and address, and to have it displayed as a web dashboard.
• MLS rules. You are responsible for following your MLS's rules on data display, use of photos, sold data and distribution to consumers.
• Advertising and license law. You are responsible for complying with your state's real estate license law and advertising rules, and with your brokerage's policies.
• Disclosures. You must give us your brokerage name, license information, required logos and disclaimers. We display them as you provide them; you are responsible for their accuracy and completeness.
• Review before sharing. You must review each dashboard before sending it to a client and tell us about any error.
• You are responsible for keeping your account details, links and passcodes confidential and for anyone you share them with.

3. Your numbers, not ours. A CMA is not an appraisal.

We present your comparables, adjustments, price range and commentary as you prepared them. We do not select comps, change your numbers or give opinions of value. If something in your CMA looks inconsistent, we may flag it and ask you before publishing, but accuracy remains your responsibility. A CMA is an agent's opinion of market value. It is not an appraisal, and every dashboard says so.

4. No guarantee of results

We do not guarantee that a dashboard will win a listing, produce a particular sale price or achieve any other result.

5. Passcodes and privacy of dashboards

Dashboards use unlisted links, are marked so search engines shouldn't index them, and can require a passcode. The passcode is a convenience feature that keeps out casual visitors. It is not bank-grade security, and anyone with the link and passcode can view the dashboard. Don't include sensitive information, such as a seller's financial, mortgage or personal identification details.

6. Ownership and license

You own your content. Your CMA, data, photos, branding and client information stay yours. You give us a limited, non-exclusive license to host, copy, format and display that content only to provide the service to you.

We own our templates. CMAView owns the dashboard designs, templates, code, the CMAView name and the website. While your dashboard is hosted, you may share its link with your clients and prospects. You may not copy, resell or reverse-engineer our templates or code. You may share screenshots of your own dashboards.

7. Hosting term and deletion

• Single: hosted for 12 months from delivery.
• Agent Pro and Team White-Label: hosted for as long as your subscription is active.
• After a Single term ends or a subscription is cancelled, dashboards stay online for 30 days, then we take them down and delete them and your uploaded files. Export or screenshot anything you want to keep before then.
• You can ask us to take down a dashboard at any time.

8. Acceptable use

You may not use CMAView to publish content that is false or misleading, that infringes someone else's rights, that discriminates in violation of fair housing laws, or that is unlawful. You may not send us malware, try to access other customers' dashboards, overload or attack the service, or resell the service without our written agreement. We may refuse or remove content that breaks these rules.

9. Fees, billing and renewal

• Prices are in US dollars and listed on our pricing page. Taxes may apply.
• Payments are processed by Stripe. Single orders and add-ons are one-time payments. Agent Pro and Team White-Label are monthly subscriptions.
• Auto-renewal: subscriptions renew automatically each month and are charged to your payment method on file until you cancel.
• Plan limits (for example, the number of dashboards per month) reset each billing period. Unused dashboards do not roll over.
• We may change prices with at least 30 days' notice by email. Changes apply from your next billing period.

10. How to cancel

You can cancel a subscription anytime through the Stripe customer portal link in your receipt email, or by emailing us at hello@cmaview.com. Cancellation takes effect at the end of your current billing period.

11. Refunds

In short: Single orders are fully refundable before delivery, and after delivery only if the dashboard materially doesn't match your CMA and we can't fix it within two revisions. Subscriptions aren't refunded for partial months. Rush fees are refunded if we miss the rush deadline. Delivered add-ons are non-refundable. See the full Refund and Revision Policy.

12. Disclaimer

Except as stated in these Terms, the service is provided "as is" and "as available," without warranties of any kind, including merchantability, fitness for a particular purpose and uninterrupted availability, to the fullest extent allowed by law.

13. Limitation of liability

To the fullest extent allowed by law, CMAView is not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, commissions, listings or data. Our total liability for any claim relating to the service is limited to the fees you paid us in the 12 months before the claim arose.

14. Indemnification

You agree to defend and indemnify CMAView against claims, losses and costs (including reasonable attorney fees) arising from content you provide, your use of a dashboard, your violation of MLS rules, license law, advertising rules or fair housing law, or your breach of these Terms.

15. Termination

You may stop using the service at any time. We may suspend or end your access, and take down dashboards, if you break these Terms, don't pay, or if we're required to by law or an MLS or rights holder. If we end the service for reasons other than your breach, we will refund any prepaid fees for the unused portion. Sections 3, 6, 12, 13, 14 and 17 survive termination.

16. Changes to these Terms

We may update these Terms. We'll post the new version here with a new "Last updated" date and, for material changes, email active customers at least 14 days before they take effect. Continuing to use the service after that means you accept the changes.

17. Governing law and venue

These Terms are governed by the laws of the State of New Hampshire, USA, without regard to conflict-of-law rules. Any dispute will be brought exclusively in the state or federal courts located in New Hampshire Rockingham County, and both parties consent to that venue.

18. General

These Terms, with the Privacy Policy and Refund and Revision Policy, are the entire agreement between us about the service. If any part is unenforceable, the rest stays in effect. Not enforcing a right isn't a waiver. You may not transfer these Terms without our consent.
